Terms of Service

Please read these Terms of Service carefully before using photogroups.app. By accessing or using the Service, you agree to be bound by these terms.

1. About the Service

Photo Groups ("the Service") is a web-based tool that allows wedding couples to organize guests into photo groups and share a custom lookup link with their guests. The Service is operated by DJ RAHUL LLC (DBA Photo Groups) at photogroups.app.

The Service includes:

• Base plan ($25 one-time) — guest photo group setup, custom link, QR code generation, wedding dashboard
• Notification upgrade ($10 one-time) — SMS and email notifications including guest check-in alerts, daily summaries, wedding day reminders, and morning-of notifications

Smart Import (AI). As a convenience, you may upload a CSV, spreadsheet, photo/screenshot, or PDF of your guest list and have it organized into photo groups automatically using AI (provided by OpenAI). AI extraction may contain errors or omissions — you are responsible for reviewing the imported groups for accuracy before saving and before sharing your guest link. Smart Import is optional; you can always enter or paste your list manually.

Activity logs. For security and dispute-resolution purposes, we keep logs of administrative and account activity, such as sign-ins and the creation, editing, deletion, or upload of guest groups, including who performed each action and when.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.

3. Account and Authentication

• You agree to provide accurate information when creating an account
• Account authentication uses one-time passcodes (OTP) sent to your email — no password is stored
• You are responsible for maintaining access to your email account
• Each purchase grants access to the Service for one (1) wedding event
• Your custom guest lookup link is active for 90 days from the date of purchase
• Multiple weddings require separate purchases
• By creating an account, you agree to receive our weekly newsletter containing wedding tips and product updates. You may unsubscribe at any time by clicking the unsubscribe link in any email or visiting photogroups.app/unsubscribe.

4. Payment

• The base Service is available for a one-time fee of $25.00 USD per wedding
• The optional notification upgrade is available for a one-time fee of $10.00 USD
• Payment is processed securely by Stripe
• All prices are in US dollars
• We reserve the right to change pricing at any time. Price changes do not affect purchases already made

5. No Refund Policy

All sales are final. We do not offer refunds under any circumstances.

This includes but is not limited to:

• Change of mind after purchase
• Wedding cancellation or postponement
• Failure to use the Service before your wedding date
• Dissatisfaction with the Service
• Technical issues caused by your own device or internet connection
• Accidental purchases
• Unused notification upgrades

By completing your purchase, you acknowledge and agree to this no-refund policy.

If you experience a technical issue with the Service that prevents it from functioning as described, please contact support@photogroups.app within 48 hours and we will work to resolve it.

6. SMS Notifications — Notification Upgrade

By purchasing the $10 notification upgrade and providing your phone number, you expressly consent to receive SMS text messages from Photo Groups sent via Telnyx from our short or long code number.

Messages you will receive include:

• Guest check-in alerts
• Daily guest summary notifications
• 24-hour wedding day reminder
• Wedding morning notification

Message frequency: Varies. Typically 2–5 messages total per wedding.

Message and data rates may apply.

To opt out: Reply STOP to any message at any time. You will be immediately unsubscribed and receive no further messages.

Consent is not a condition of purchase. SMS notifications are optional. The base Service does not require a phone number.

Opting out of SMS does not entitle you to a refund of the $10 notification upgrade fee.

Guest SMS: Wedding guests who provide their phone number via the guest link page and check the SMS consent box agree to receive photo group notifications for that specific wedding event. Guest consent is separate from and independent of the couple's account.

7. No Data Backup

Photo Groups does not back up your data.

This means:

• Guest data uploaded via CSV is not backed up by us
• Guest data is scheduled for permanent deletion 2 days after your event end date
• In the event of data loss, service interruption, technical failure, or account termination, we cannot restore or recover your guest list or photo group assignments
• You are solely responsible for maintaining your own backup copies of all data you upload to the Service
• We strongly recommend you retain your original CSV file at all times

We are not liable for any data loss. By using the Service, you acknowledge and accept this limitation.

8. Guest Data & Consent

By uploading guest names and information to the Service, you represent and warrant that:

• You have the right to share this information
• Your guests are aware their name will be used to facilitate photo group lookup at your wedding event
• You have obtained any necessary consent from your guests to process their personal information
• The guest data you upload is accurate and complete

You agree to indemnify Photo Groups against any claims arising from your use of guest data in violation of applicable privacy laws.

9. Free Codes & Promotional Credits

Photo Groups may issue promotional codes or complimentary access codes at its discretion. Free codes:

• Are issued for one-time use per wedding event
• Cannot be transferred or resold
• May expire at any time
• Do not include the notification upgrade unless explicitly stated
• Are provided in exchange for honest feedback or reviews where applicable

Misuse or redistribution of free codes may result in account termination.

10. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload data you do not have the right to use
• Attempt to reverse engineer, hack, or disrupt the Service
• Use the Service to collect or harvest personal data beyond your own wedding guests
• Resell or transfer your access to the Service to another party without our written consent
• Use automated tools to access or scrape the Service
• Abuse the SMS notification system or attempt to send unauthorized messages

11. Intellectual Property

All content, design, code, and materials on photogroups.app are owned by or licensed to Photo Groups. You may not copy, reproduce, or distribute any part of the Service without our written permission.

Your guest data remains yours. We claim no ownership over the names or information you upload.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• SMS messages will be delivered without delay or interruption
• Results obtained from using the Service will be accurate or reliable

13. Limitation of Liability

To the fullest extent permitted by law, Photo Groups and its operators shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of data, revenue, profits, or business opportunities
• Damages arising from your use or inability to use the Service
• Failed or delayed SMS message delivery
• Any issues arising from third-party services including Stripe, MongoDB, Vercel, Resend, or Telnyx

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid for the Service.

14. Indemnification

You agree to indemnify and hold harmless Photo Groups and its operators from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Violation of these Terms
• Your use of guest data in violation of privacy laws
• Any claims by your wedding guests related to their data

15. Third-Party Services

The Service integrates with third-party services including Stripe (payments), MongoDB Atlas (data storage), Vercel (hosting), Resend (email), Telnyx (SMS), and OpenAI (AI-powered Smart Import). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the actions or policies of these third parties.

16. Service Availability

We do not guarantee uninterrupted availability of the Service. We may suspend or discontinue the Service at any time with or without notice. We are not liable for any inconvenience or loss caused by service downtime or discontinuation.

17. Changes to Terms

We reserve the right to update these Terms at any time. We will post the updated Terms on this page with a new date. Continued use of the Service after changes are posted constitutes your acceptance of the new Terms.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of New Jersey.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Photo Groups regarding your use of the Service.
